Terms & Conditions, No Divots, LLC, Effective Date: March 1, 2026
These Terms and Conditions ("Terms") govern your access to and use of the golf simulator facilities, equipment, and services provided by No Divots, LLC ("we," "us," or "Company"), located at 1021 US-431, Suite 17, Anniston, AL 36206. By booking a session, entering the premises, paying any fee, or using any simulator or related equipment, you ("you," "User," or "Participant") agree to be bound by these Terms. If you do not agree, do not use our services.
1. Acceptance and Eligibility
By using our services, you confirm that:
You are at least 16 years old and may book and participate without adult supervision, or
If under 16 years old, a parent or legal guardian has reviewed and agreed to these Terms on your behalf and is present to supervise you at all times during your session.
You (or your parent/guardian if under 19) represent that you are physically fit to participate, have no medical conditions that would make use unsafe, and are not under the influence of alcohol, drugs, or any substance that could impair judgment or coordination. Agreement to these Terms is confirmed by completing the booking process (including any required acceptance checkbox), or by entering or using the facility after these Terms are displayed or provided.
2. Reservations and Usage
Simulator time can be reserved in advance online via https://nodivots.golfbooking.us/calendar.php or by calling us at 256-282-2205.
Walk-in reservations are allowed, but we do not guarantee a bay will be available.
Usage is strictly limited to your paid reserved time slot. Overstaying may result in additional charges at $3 per 5 minutes and/or immediate removal without refund.
No-shows or cancellations without 3 hours' notice forfeit payment and receive no refund. Late arrivals may receive reduced time without credit or refund.
Maximum occupancy per bay/simulator: 6 people. Overcrowding is prohibited for safety reasons.
3. Rules of Conduct and Safety
You agree to:
Follow all posted rules, instructions, staff directions, safety guidelines, and the additional rules on our website at all times.
Wear appropriate golf-appropriate footwear (no spikes, open-toed shoes, heels, or street shoes that could damage flooring/mats).
Refrain from roughhousing, excessive force, swinging clubs outside the designated hitting area, horseplay, or any reckless or disruptive behavior.
Keep food, drinks, alcohol, smoking/vaping, illegal substances, and any intoxicating materials away from simulators and equipment. No alcohol, drugs, smoking, vaping, or illegal substances are permitted on the premises at any time.
Report any equipment malfunction, damage, or safety concern to staff immediately.
Not tamper with, modify, climb on, or attempt to repair any equipment or facility components.
If using personal clubs or balls, they must be clean, undamaged, and suitable (no ground-insertion tees or items likely to damage screens/mats, per website rules).
Violation of these rules may result in immediate ejection without refund and potential liability for any resulting damages or costs.
4. Assumption of Risk, Release of Liability, and Waiver
Golf simulator activities involve inherent and foreseeable risks, including but not limited to:
Personal injury (e.g., strains, sprains, bruises, cuts, impacts from clubs or balls, slips, trips, falls, eye injuries, overexertion, or more serious harm up to and including death).
Property damage or loss (to your belongings or the facility).
Equipment failure or malfunction.
You knowingly and voluntarily assume all such risks. To the fullest extent permitted by Alabama law, you hereby release, waive, discharge, and covenant not to sue No Divots, LLC, its owners, members, managers, employees, agents, contractors, insurers, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, causes of action, damages, costs, or expenses (including attorney fees) arising from or related to your use of the facility, equipment, participation in activities, or presence on the premises, including those caused by the ordinary negligence (but not gross negligence, wanton conduct, willful misconduct, or intentional acts) of any Released Party.
You agree to indemnify and hold harmless the Released Parties from any claims, losses, liabilities, damages, or expenses (including reasonable attorney fees) brought by you, your guests, your minor children (if applicable), or any third party arising from your actions, your violation of these Terms, or your use of the facility. Parents/guardians of participants under 19 agree to this indemnity for any claims related to the minor's use.
This release and waiver is intended to be as broad and inclusive as permitted by Alabama law and shall be effective even if caused in whole or in part by the negligence of a Released Party (excluding gross negligence or willful misconduct). You acknowledge that you have read and understand this section fully.
5. Equipment and Property Damage
You must use all equipment and the facility responsibly and in accordance with instructions. If any equipment (including but not limited to simulators, screens, projectors, mats, clubs, balls, furniture, or premises) is damaged, lost, or destroyed due to your misuse, negligence, recklessness, intentional acts, violation of these Terms, or use of unsuitable personal equipment, you agree to pay the full cost of repair, replacement, or restoration at current market rates ("you break it, you buy it"). We reserve the right to charge your payment method on file, require immediate payment, or pursue legal remedies for reimbursement.
You release the Released Parties from any liability for loss, theft, or damage to your personal property while on the premises.
6. Payment and Fees
All fees, including any deposits, are due at booking or upon arrival.
We accept major credit/debit cards and cash. Prices are as stated and include applicable taxes unless otherwise noted.
No refunds for completed, partially used, or no-show sessions except as required by law.
7. Privacy and Surveillance
We collect and use personal information only as necessary for bookings, payments, safety, and operations, in accordance with applicable law. For more details, see our separate Privacy Policy at https://www.nodivots.net/privacy-policy. The facility may use video surveillance for safety, security, and operational purposes; footage may be reviewed or retained as needed.
8. Additional Rules
You agree to comply with all rules and guidelines posted on our website at https://www.nodivots.net/rules (as may be updated from time to time), which are incorporated into these Terms by this reference. Violation of any such rules constitutes a violation of these Terms.
9. General Provisions
Governing Law and Venue: These Terms are governed exclusively by the laws of the State of Alabama, without regard to conflict of laws principles. Any disputes arising from or related to these Terms, your use of the facility, or these premises shall be resolved exclusively in the state or federal courts located in Calhoun County, Alabama. You consent to the personal jurisdiction and venue of such courts.
Force Majeure: We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to power outages, equipment failures (not due to our negligence), severe weather, acts of God, or other unforeseen events.
Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Amendments: We may update these Terms at any time; continued use after changes constitutes acceptance.
Entire Agreement: These Terms constitute the entire agreement between you and us regarding use of the facility and supersede any prior understandings.
By booking, entering, or using the facility, you acknowledge that you have read, understood, and voluntarily agree to these Terms, including the assumption of risk, release, waiver, and indemnity provisions.
